Polymarket Legal States 2026

Polymarket US is a federally regulated prediction market that lets users trade real-money event contracts covering sports, esports, politics, crypto, weather, technology, culture and economics.

The wider Polymarket brand was founded by Shayne Coplan in 2020 and grew into one of the world's most popular prediction markets - particularly through its international, crypto-based platform.

After its international platform was banned from operating in the US in 2022, Polymarket acquired derivatives exchange QCX and its affiliated clearinghouse for $112 million in July 2025, paving the way for Polymarket US to launch for American users in December 2025.

As of today, Polymarket US is available in 41 U.S. states, Washington, D.C. and Puerto Rico - including major states without legal sportsbooks, like California and Texas.

Polymarket US vs. Polymarket.com: Why Are There Two Platforms?

Polymarket US and Polymarket.com share a brand, but they are two different prediction markets built for two different regulatory environments.

Polymarket.com

The original Polymarket launched in 2020 as a crypto-based prediction market and became especially well known for their political, economic and current-event markets. Trading takes place through blockchain infrastructure, with crypto-backed funds used to buy and sell positions.

That version of Polymarket was effectively forced out of the U.S. market in 2022. 

Polymarket reached a $1.4 million settlement with the CFTC in January 2022 over offering event contracts without the required registration, agreed to wind down the affected markets and stopped allowing U.S. users to trade on Polymarket.com.

So while Polymarket.com continued operating internationally, it is no longer a legal option for American traders.

Polymarket US

In order to return to the US market, in July 2025, Polymarket bought QCEX for $112 million, acquiring a federally regulated derivatives exchange and clearinghouse in the process.

Those businesses became the foundation of the US version of Polymarket: QCX now operates as Polymarket US, while QC Clearing operates as Polymarket Clearing.

Polymarket US isn't simply Polymarket.com with American accounts switched back on. It's a federally regulated U.S. exchange operating under CFTC oversight and a formal rulebook designed to keep its markets fair and orderly.

That includes monitoring trading for manipulation and other suspicious activity, maintaining trading records, investigating potential rule violations and taking disciplinary action when necessary. Its contracts and trading rules must also comply with the federal requirements governing regulated derivatives markets.

The accounts aren't connected, the market catalogs differ and each platform has its own support system. If you're in the United States, Polymarket US is the version designed and regulated for you.

Where Is Polymarket US Available?

Polymarket US is currently available in 41 states:

Alabama, Alaska, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nebraska, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, Wisconsin and Wyoming.

Polymarket US is also available in Washington, D.C. and Puerto Rico.

To use Polymarket US, you must generally be at least 18 years old, or meet any higher minimum age required in your jurisdiction.

You may also be required to complete identity verification, KYC and anti-money-laundering checks, sanctions screening and location checks confirming you are accessing the platform from an eligible jurisdiction.

States Where Polymarket US Is Not Available

Polymarket US is currently unavailable in nine states:

Arizona, Illinois, Massachusetts, Maryland, Michigan, Montana, Nevada, Ohio and Washington.

Users that travel outside Polymarket's supported service area cannot place new orders, including orders intended to close an existing position before settlement.

In other words, if you open a a position while located in California, you will not be able to close your contracts early if you travel to Arizona before it settles.

Why Isn't Polymarket US Available in Every State?

One thing I've learned covering prediction markets is that an unavailable state doesn't automatically tell you why a platform is unavailable there.

Polymarket US operates as a federally regulated derivatives exchange, but several states have argued that some event contracts — particularly contracts involving sports — also fall under their state gambling laws. Prediction market operators have generally responded that the Commodity Exchange Act gives the CFTC exclusive authority over contracts traded on federally regulated exchanges.

Those arguments are now being tested in courts around the country.

Nevada is the clearest Polymarket-specific example. The Nevada Gaming Control Board sued Polymarket US in January 2026. A state court first issued a temporary restraining order and then granted a preliminary injunction in May preventing Polymarket from offering sports, election and entertainment contracts in Nevada while the case continues.

Not every state on Polymarket's unavailable list has an equivalent court order. In several jurisdictions, access is simply geofenced while the wider regulatory fight develops.

So there isn't one nine-state rule explaining every exclusion. The common thread is that Polymarket currently does not accept customers in those nine states, which is why we classify the platform as Not Available in each of them.

How Does Polymarket US Work?

Polymarket US is a prediction market, so users trade contracts tied to the outcome of real-world events rather than placing a conventional wager against a sportsbook.

A contract might ask whether a particular team will win a game, whether Bitcoin will finish above a certain price or whether an economic indicator will reach a specified level.

Contracts ultimately settle based on a predetermined outcome. A winning $1 contract pays $1, while a losing contract settles at $0.

The price before settlement changes as traders buy and sell.

For example, a contract trading at 60¢ can broadly be read as the market assigning the outcome around a 60% probability. Buying at that price costs 60¢ per contract. If the contract eventually settles at $1, the gross profit is 40¢ per contract.

You also don't have to hold every position until settlement. Contracts can be sold while the market is still open, allowing you to exit after the price moves.

Polymarket US matches trades between market participants rather than acting as the house on the other side of every position.

Trading on Polymarket vs Betting on a Sportsbook

For someone coming from sportsbooks, I think there are three Polymarket mechanics worth understanding straight away.

First, the contract price works a lot like implied probability. A contract bought for 60¢ represents roughly a 60% market probability. If you held that contract until it settled at $1, you'd risk 60¢ to make 40¢ — roughly equivalent to -150 American odds. A 40¢ contract works the other way: you're risking 40¢ to make 60¢, roughly +150.

Second, your price isn't fixed once you enter. If you buy at 40¢ and other traders later push the market to 65¢, you can sell the position before the event finishes.

That's different from a sportsbook cash-out. A sportsbook decides whether to offer you a cash-out and sets the price. On an exchange such as Polymarket US, you're selling your position back into a market where other participants are submitting buy and sell orders.

That makes liquidity and the spread important. A market might show an attractive headline price, but if there aren't enough orders available around that level, a larger trade may execute at different prices.

Polymarket US also supports tools you normally associate more with trading exchanges, including standing limit orders. That lets you specify the price you're willing to buy or sell at instead of automatically accepting whatever price is currently available.

Once you understand probability, liquidity and the ability to trade out of a position, Polymarket starts making much more sense from a sports betting perspective.

What Can You Trade on Polymarket US?

DraftKings Predictions is built around event-based prediction markets, where users trade yes/no contracts tied to real-world outcomes.

Depending on your state, these markets can include:

  • Sports outcomes (game results, season-long events, etc.)
  • Economic indicators
  • Crypto
  • Commodities

At the moment, DraftKings Predictions is more conservative than many national competitors - like Kalshi and Polymarket - when it comes to market categories. Politics, culture and entertainment markets are not widely offered yet, though DraftKings has signaled interest in expanding its market mix over time.

More importantly, however, not every state gets access to all of DraftKings Prediction's market types.

Can I Win Real Money on Polymarket US?

Yes. Polymarket US uses real-money event contracts.

There are two main ways a successful trade can generate a profit.

You can hold a winning contract until settlement. If you buy a contract for 35¢ and it later settles at $1, the gross profit is 65¢ for each contract.

You can also sell before settlement. If you buy at 35¢ and the market later moves to 60¢, you can potentially sell the position at or around the new market price without waiting to see whether the underlying event eventually happens.

The reverse is also true. Prices can move against you, and a contract that ultimately resolves incorrectly settles at $0.

Why Is Polymarket US Legal?

When I look at Polymarket US from a regulatory perspective, I start with the entities behind the product.

QCX LLC received CFTC designation as a Designated Contract Market on July 9, 2025. Polymarket then announced on July 21 that it had acquired QCEX for $112 million.

That acquisition included both the exchange and its clearing infrastructure.

QCX LLC now does business as Polymarket US. Separately, QC Clearing LLC d/b/a Polymarket Clearing is registered with the CFTC as a Derivatives Clearing Organization. It handles the regulated clearing side of the structure behind contracts traded through the U.S. platform.

There is even another layer between the customer and those regulated entities: the consumer Polymarket app is operated by PM US Tech and functions as the front end connecting customers to the exchange and clearinghouse.

That's a much more useful explanation of Polymarket's U.S. legal structure than simply saying the company is "CFTC regulated." The app, exchange and clearinghouse each have distinct roles.

Federal regulation has not ended every state-level dispute.

New York Attorney General Letitia James filed a lawsuit against Polymarket US on September 24, 2026, alleging that its event contracts constitute unlicensed gambling under New York law. Polymarket filed its own federal lawsuit later that day, arguing that New York cannot apply its gambling regime to contracts offered through a federally regulated derivatives exchange.

Both cases are ongoing.

As of September 29, no court order has barred Polymarket US from operating in New York, and the platform remains available to eligible New York users under its federal DCM framework. The state's challenge has therefore created an active legal dispute, rather than a current New York prohibition on Polymarket US.

Is Polymarket legal in the United States?

Yes. Polymarket US operates through a CFTC-regulated Designated Contract Market and is currently available in 41 states, Washington, D.C. and Puerto Rico.

The international Polymarket.com platform is a separate product and does not allow U.S. residents to deposit money or trade.

What states is Polymarket US not available in?

That is particularly notable because California does not have legal online sportsbooks. Polymarket US operates there through the federal commodities framework governing its CFTC-regulated exchange rather than through a California sports betting license.

Is Polymarket US legal in Texas?

Yes. Polymarket US is currently available in Texas.

Texas does not have regulated online sportsbooks, so Polymarket gives residents access to sports and other event contracts through a different legal framework. Users still need to satisfy Polymarket's age, identity and geolocation requirements before trading.

Is Polymarket US legal in Florida?

Yes. Florida residents who meet Polymarket's eligibility requirements can currently use Polymarket US.

Polymarket operates separately from Florida's regulated sportsbook market. Its event contracts are offered through a federally regulated derivatives exchange rather than under the state sports betting structure used by licensed sportsbook operators.

Is Polymarket US legal in New York?

Polymarket US remains available in New York.

The New York Attorney General sued Polymarket on September 24, 2026, alleging that its prediction markets violate state gambling laws. Polymarket disputes that interpretation and filed a federal lawsuit arguing that its federally regulated exchange falls under the Commodity Exchange Act and CFTC jurisdiction.

The litigation remains ongoing, and no court order currently prevents Polymarket US from operating in New York.

Is Polymarket US legal in New Jersey?

Yes. Polymarket US is currently available in New Jersey.

New Jersey already has one of the country's most mature regulated sportsbook markets, but Polymarket US operates under a separate federal derivatives framework.

Users access event contracts through Polymarket's CFTC-regulated exchange rather than through a sportsbook licensed by the New Jersey Division of Gaming Enforcement.

Is Polymarket US legal in Arizona?

No. Polymarket US is currently not available in Arizona.

Arizona is geofenced by the platform, meaning users physically located there cannot place new Polymarket US orders.

That restriction also matters when traveling: a position opened in an available state cannot be actively closed through a new order while the user is in an unsupported jurisdiction.

Is Polymarket US legal in Illinois?

No. Polymarket US is currently not available in Illinois.

Illinois users cannot open new positions while physically located in the state. Polymarket's availability is based on the user's current location, so an account created elsewhere does not override the state's geofencing restrictions.

Is Polymarket US legal in Michigan?

No. Polymarket US is currently not available in Michigan.

Michigan has regulated online sportsbooks, casinos and poker, but Polymarket US is not currently part of the state's available real-money market. Users physically located in Michigan cannot place new Polymarket orders even if they created their account in a supported state.

Is Polymarket US legal in Ohio?

No. Polymarket US is currently not available in Ohio.

Ohio regulates conventional sports betting separately through its state framework, while Polymarket US operates as a federally regulated prediction market. At present, Polymarket geofences Ohio and does not accept new orders from users located there.

Is Polymarket US legal in Washington?

No. Polymarket US is currently not available in Washington state.

Washington already has unusually restrictive rules around online gambling compared with most states, and Polymarket currently geofences the state entirely. Users located in Washington cannot place new orders through Polymarket US.

Is Polymarket US legal in Nevada?

No. Polymarket US is currently unavailable in Nevada.

Nevada is one of the clearest examples of a direct state challenge to Polymarket's federal regulatory position. The Nevada Gaming Control Board sued Polymarket US in January 2026, and a state court granted a preliminary injunction in May preventing it from offering sports, election and entertainment event contracts while the case continues.

Polymarket therefore remains unavailable in Nevada even though its exchange holds federal CFTC designation.

Is Polymarket US available in Puerto Rico?

Yes. Polymarket US is currently available to eligible users in Puerto Rico.

Puerto Rico sits outside the 50-state count, which is why we describe Polymarket as available in 41 states plus Washington, D.C. and Puerto Rico rather than calling it a 42-state platform. Users in Puerto Rico are still subject to the same account verification, age and location controls applied elsewhere on Polymarket US.
