Fanatics Markets Legal States 2026
Fanatics Markets is Fanatics’ real-money prediction market platform, where users can trade trade simple yes/no event contracts covering sports and other real-world outcomes.
It sits inside the much broader Fanatics ecosystem, a brand already familiar to millions of sports fans through merchandise, collectibles, trading cards and Fanatics Sportsbook.
Unlike their sportsbook product, Fanatics markets operates under a federal commodities framework rather than a traditional state-by-state sportsbook licensing model, which allows them to operate in many places where sports betting is not legal.
That gives the product a very different geographic footprint: As of today, Fanatics Markets is available in 22 states and four U.S. territories - including major states without statewide online sports betting, like California and Texas.
Where Is Fanatics Markets Available?
Fanatics Markets is currently available in the following 22 states:
- Alabama
- Alaska
- California
- Delaware
- Florida
- Georgia
- Hawaii
- Idaho
- Maine
- Minnesota
- Mississippi
- Nebraska
- New Hampshire
- New Mexico
- North Dakota
- Oklahoma
- Oregon
- Rhode Island
- South Carolina
- South Dakota
- Texas
- Utah
The platform is also available in American Samoa, Guam, Puerto Rico and the U.S. Virgin Islands.
Fanatics uses geolocation to determine whether you are currently inside its service area. Being a resident of an eligible state is not enough if you are physically somewhere the product is unavailable when you try to trade.
Fanatics Markets is currently unavailable in:
Arizona, Arkansas, Colorado, Connecticut, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Missouri, Montana, Nevada, New Jersey, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Vermont, Virginia, West Virginia and Wyoming, plus Washington, D.C.
That can create an unusual situation when traveling. Users outside its supported service area cannot place new orders, including orders intended to close an existing position before settlement.
In other words, a position opened while you are in California could become temporarily untradeable if you travel to New York before it settles.
Why Doesn't Fanatics Markets Work in Every State?

If you come from sports betting, throw the usual legal sportsbook map out the window.
Fanatics Sportsbook is available in places such as New York, New Jersey and Pennsylvania, while Fanatics Markets currently isn't. Flip the map around and you get California and Texas, where Fanatics Markets is live even though Fanatics cannot offer its regular online sportsbook.
That's the easiest way to think about this product. Fanatics Markets and Fanatics Sportsbook may live inside the same broader Fanatics ecosystem, but they operate through different regulatory lanes.
Always check the Markets availability list rather than assuming access based on whether Fanatics Sportsbook operates in your state.
How Does Fanatics Markets Work?
Fanatics Markets lets you trade event contracts based on whether a defined outcome will happen.
Most markets give you opposite positions such as Yes and No. A contract's price can move between the two extremes as the market's view of the outcome changes. A Yes contract trading for 60 cents, for example, effectively reflects a market price of roughly 60% for that outcome.
If you buy a Yes contract and the event resolves Yes, the contract pays $1. If it resolves No, that contract pays nothing.
Say you buy 10 Yes contracts at $0.60 each:
- Cost: $6 before fees
- If Yes wins: $10 settlement value
- Gross profit: $4 before fees
- If No wins: $0 settlement value
You do not necessarily have to hold until the final result. Fanatics allows users to submit an order to sell an existing position before settlement while trading remains available - although an exit is not guaranteed because price, liquidity, market status and location restrictions can all get in the way.
Fanatics Markets for a Sports Bettor

The biggest adjustment for a sportsbook bettor is realizing that the price itself can move after you enter.
If I take a normal sportsbook bet at -110, that ticket is basically frozen. My payout does not improve because everybody suddenly agrees with me five minutes later.
A prediction-market contract behaves differently. If I buy Yes at 40 cents and the market later pushes Yes to 70 cents, my position has gained value before the event has even settled. I may be able to sell it rather than waiting for the final result.
You still need to be right often enough to overcome the price and fees, but you're managing a position rather than simply waiting for a bet slip to grade.

What Markets Does Fanatics Markets Offer?
Fanatics Markets covers far more than sports. Its current main categories include:
- Sports: football, basketball, baseball, tennis, soccer, golf, hockey and other sports markets.
- Crypto: Bitcoin, Ethereum and other cryptocurrency outcomes.
- Politics: elections, congressional control and other political outcomes.
- Culture: entertainment, awards, music and other pop-culture events.
- Economy: Federal Reserve decisions, inflation, unemployment and other economic indicators.
Individual markets come and go as events approach and resolve, so the exact selection is constantly moving.
Can I Win Real Money on Fanatics Markets?
Yes. Fanatics Markets uses real money.
You pay real money to acquire event contracts, and profitable positions can generate withdrawable cash. If a contract you hold resolves in your favor, it generally settles at $1 per contract. A losing contract settles at zero.
Your potential profit therefore depends on what you paid.
Buying 20 contracts at $0.35 costs $7 before fees. If those contracts settle at $1, they return $20, producing a $13 gross profit before fees. If the position loses, the contracts settle at zero and the $7 position is lost.
Fanatics also charges trading fees. Its current schedule ranges from fractions of a cent up to $0.02 per contract, with the exact amount depending on the contract price.
You may also be able to sell a position before settlement. In that case, your return depends on the price at which somebody takes the other side rather than the eventual $1-or-$0 settlement.
Why Is Fanatics Markets Legal?

The key thing I want readers to understand is that Fanatics Markets is federally regulated as a prediction market product. It is not simply Fanatics Sportsbook operating in extra states under another name.
Event contracts offered through the platform fall within the federal commodities regulatory system overseen by the CFTC. The exchange currently used for Fanatics Markets contracts is registered with the CFTC as both a designated contract market and derivatives clearing organization.
That federal framework explains why the availability map can look almost backwards to a sportsbook bettor. States decide whether to license conventional sportsbooks. Federally regulated prediction markets operate through a different legal structure.
There is still an active fight over how far state gambling regulators can go in restricting sports event contracts. Courts and regulators have not produced one uniform national answer on that issue.
