Gemini Predictions Legal States 2026
Gemini Predictions is a federally regulated prediction market available across all 50 U.S. states and Washington, D.C. It lets users trade real-money event contracts covering sports, politics, crypto, economics and plenty of other subjects through the same broader Gemini platform best known for cryptocurrency trading.
Gemini itself has been around since 2014, when twin brothers Tyler and Cameron Winklevoss founded the company as a crypto exchange. It has since grown into a much broader financial platform spanning crypto trading, institutional custody, staking, a U.S. credit card, stock trading and now prediction markets.
That history gives Gemini Predictions a considerably more established parent company than many newer prediction platforms. The Predictions product launched in December 2025 through Gemini Titan, Gemini's federally regulated derivatives exchange, and has since become part of the company's wider push beyond crypto and into traditional financial and event markets.

How Does Gemini Predictions Work?
Gemini Predictions uses Yes/No event contracts tied to measurable real-world outcomes.
Suppose there is a contract asking whether a particular team will win a game. If you think it will, you can buy Yes. If you think it won't, you can buy No.
Contracts trade between $0 and $1. If you buy a Yes contract at $0.40 and the event resolves Yes, the contract settles for $1. Your gross profit is $0.60 per contract before trading fees. If the answer is No, that contract settles at $0.
The price is created by the market. Buyers submit bids, sellers submit asks and trades occur when the two sides match. As traders react to new information, prices move with them.
You also don't necessarily have to wait until the event settles. Gemini allows you to sell an existing position before the market closes, subject to there being sufficient market liquidity and an available buyer.
Gemini uses a maker/taker fee model. Orders that immediately match existing liquidity generally pay a higher taker rate, while orders that sit on the book and provide liquidity receive the lower maker rate. There are currently no separate settlement or membership fees.
Gemini Predictions for a Sports Bettor

If you're coming from DraftKings or FanDuel, Gemini takes a minute to rewire your brain.
At a sportsbook, you're looking at a price the book gives you. Here, you're looking at an actual market. Other traders are bidding, asking and changing the price as money moves around.
That makes liquidity worth paying attention to. A busy NFL market with lots of buyers and sellers can feel pretty smooth. A niche market with thin trading can move much faster when somebody places a decent-sized order.
The other big difference is that your position has a value before the event finishes. Buy something at 35 cents and watch it move to 65 cents? You can potentially sell there instead of sweating the final result for another three hours.
Once you see contracts as positions rather than sportsbook tickets, Gemini makes a lot more sense.

What Markets Does Gemini Predictions Offer?
Gemini has expanded well beyond the crypto markets you might expect from the brand.
Its current prediction-market categories include:
- Sports: Football, basketball, baseball, golf, soccer, hockey, motorsports and other sporting events.
- Crypto: Bitcoin, Ethereum and other cryptocurrency-related outcomes.
- Politics: Elections, congressional races, international politics, court-related outcomes and other political events.
- Economics: Inflation, interest rates and other macroeconomic indicators.
- Commodities: Oil, gold, natural gas, silver, copper and related markets.
- Tech: Technology companies, products and industry developments.
- Business: Corporate events, IPOs, company performance and other business outcomes.
- Weather: Daily temperature markets, including how hot it will get in cities such as New York, Los Angeles and Boston.
- Culture: Entertainment markets such as the Eurovision winner, Oscar winners and movie review scores.
The exact contracts change constantly as events resolve and new ones become relevant. Gemini may also add, remove or reorganize categories over time.
Can I Win Real Money on Gemini Predictions?
Yes. Gemini Predictions is a real-money platform.
Positions are funded in U.S. dollars from your Gemini balance. If you hold a winning contract through resolution, it settles at $1 per contract. A losing contract settles at $0.
For example, buying 100 Yes contracts at $0.35 costs $35 before fees. If Yes ultimately wins, those contracts settle for $100, leaving a $65 gross profit before trading costs.
You can also realize a profit or loss before resolution by selling the contracts at their current market price. Buy at $0.35 and later sell at $0.60, for example, and you've captured the increase without needing to wait for the underlying event to finish.
Trading fees vary depending on whether your order provides or removes liquidity from Gemini's order book, so the price movement alone does not equal your exact net profit.
Why Is Gemini Predictions Legal?

Gemini is an interesting case because it has built considerably more of the regulatory plumbing itself than most consumer prediction-market brands.
Gemini Predictions runs through Gemini Titan, LLC, a CFTC-regulated Designated Contract Market (DCM). Gemini also owns Gemini Olympus, LLC, a CFTC-registered Derivatives Clearing Organization (DCO), which means the group controls both the exchange and the clearing side of its prediction-market operation.
That federal structure is why Gemini can offer Predictions nationwide without collecting a separate sportsbook license from every state. Event contracts traded on a CFTC-regulated derivatives exchange sit under a different regulatory framework from wagers accepted by a state-licensed sportsbook.
States don't universally agree with that interpretation when sports are involved.
New York's attorney general has sued Gemini Titan, arguing that Gemini Predictions constitutes unauthorized gambling and sports wagering under New York law. Connecticut has likewise ordered Gemini to stop making sports event contracts available to its residents.
However, Gemini remains available in both states at the time of writing, while the courts are still working through how far individual states can go in applying their gambling laws to federally regulated event contracts.
